1. About Charter Boats Direct Pty Ltd

Charter Boats Direct Pty Ltd is a booking platform that connects customers directly with charter boat operators. We do not own, manage, or operate any boats listed on our site. Our role is strictly limited to:

• Providing real-time availability based on boat owners' schedules
• Facilitating customer enquiries and bookings on behalf of boat operators
• Passing along all booking details to the selected operator

Important: Once you confirm a booking and payment is made, your agreement and relationship are now directly with the charter boat operator, not Charter Boats Direct Pty Ltd.

2. Responsibility & Liability

Charter Boats Direct Pty Ltd does not accept responsibility for any part of the boating experience once your booking has been confirmed and payment has been processed.

This includes (but is not limited to):

• Changes to your booking by the boat operator
• Cancellation policies, weather-related changes, or rescheduling
• Conduct of the crew or services provided on the day
• Safety, operational procedures, or customer service onboard
• Refunds, compensation, or disputes relating to your trip

All aspects of your charter (including terms, inclusions, exclusions, and liability) are governed by the boat operator's Terms and Conditions.

3. Operator Terms & Agreement

Prior to completing your booking, you will be required to:

• Read and accept the specific Terms & Conditions of the individual boat operator
• Agree that Charter Boats Direct Pty Ltd is not a party to that contract
• Acknowledge that all post-booking support, changes, or issues must be taken up directly with the boat operator

Once payment has been made, your booking is final and binding under the terms of the boat operator.

4. Disputes & Complaints

Any complaints, requests for refunds, or disputes must be directed exclusively to the charter boat operator.

Charter Boats Direct Pty Ltd will not intervene in disputes or offer refunds, credits, or compensation under any circumstance once a booking has been confirmed.

We are happy to assist you during the enquiry and booking process but after payment has been made, all responsibility shifts to the charter provider.

5. Account Registration

To use our booking platform, you must:

• Be at least 18 years of age
• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Accept these Terms & Conditions and our Privacy Policy
• Notify us immediately of any unauthorized use of your account

6. Booking Process

When making a booking through our platform:

• All bookings are subject to availability and operator approval
• Pricing and availability are subject to change without notice
• You are responsible for providing accurate booking information
• Payment must be completed before booking confirmation
• Booking confirmations will be sent via email

7. Payment Terms

Payment processing is handled securely through our payment partners. By providing payment information, you agree to:

• Pay all applicable fees and charges
• Authorize us to charge your payment method for confirmed bookings
• Understand that all payments are non-refundable unless otherwise stated by the operator
• Comply with any additional payment terms set by individual operators

8. Prohibited Activities

You agree not to:

• Use the platform for any illegal or unauthorized purpose
• Interfere with or disrupt the platform's functionality
• Attempt to gain unauthorized access to any part of the platform
• Provide false or misleading information
• Violate any applicable laws or regulations

9. Changes to These Terms

Charter Boats Direct Pty Ltd reserves the right to update or modify these Terms & Conditions at any time. It is your responsibility to review this page periodically. Continued use of the website and booking services constitutes acceptance of any changes made.

10. Google Calendar Integration

Our platform offers optional integration with Google Calendar to help operators manage their booking schedules. By connecting your Google account, you authorize Charter Boats Direct Pty Ltd to access and manage your Google Calendar data solely for booking synchronization. You can revoke this access at any time through your Google Account settings at https://myaccount.google.com/permissions.

Important:We are not responsible for Google's own service uptime, data accuracy, or any issues arising from your use of Google Calendar. Our platform uses Google Calendar integration as a convenience feature, and any downtime, errors, or issues with Google Calendar services are outside our control.

11. Governing Law

These Terms & Conditions are governed by the laws of New South Wales, Australia. Any disputes must be resolved in NSW courts.
